Justice Scalia Interprets the Constitution
In an interview with California Lawyer magazine, Justice Antonin Scalia proclaimed the US Constitution does not protect women from discrimination.
The very conservative Justice states "Certainly the Constitution does not require discrimination on the basis of sex." The only issue is whether it prohibits it. It doesn't. "Nobody ever thought that that's what it meant.” Nobody ever voted for that. "If the current society wants to outlaw discrimination by sex, hey we have things called legislatures, and they enact things called laws."
On behalf of women everywhere "Thanks for setting women’s rights back another 100 years".
Justice Scalia, what about the 14th amendment? The equal protection clause which requires each state to provide "equal protection under the law to all people within its jurisdiction."
The last time I checked WOMEN are People! To infer the equal protection clause doesn't protect them from discrimination is ludicrous! That's exactly what it was meant to do.
After the civil war during reconstruction the laws in the US were changing to reflect the diverse population’s needs. Our ancestors were trying to unite the war torn nation by ensuring THE LAW IS FOR ALL.
It's hard to believe that a Justice of the highest court in the land doesn't think that EQUAL PROTECTION means EQUAL PROTECTION!
I read the Protection clause Justice Scalia and didn't see any references to it not including women! As a matter of fact this clause was the basis for the 1954 Supreme Court decision to eliminate racial segregation (Brown v, Board of education).
EQUAL PROTECTION for all People! Means exactly what it says. That one statement should have ended the practice of all discrimination whether it is Race, Gender, Religion, or Sexual Preference.
In the present state of our country is it really necessary to amend the Constitution yet again to point out the obvious! Or maybe we should draft a Constitution by women for women.
Justice Scalia you just declared your own mother a second class citizen. Way to go!
